What Do I Do?
Defending clients in the Olympia, Tacoma, and Pierce County areas
Things to Do
Whether an officer arrives at your door or you are pulled over in a vehicle, be polite and courteous. You will likely be treated the same way you treat others. If you are uncooperative and disrespectful, it will only make matters worse as it will be reflected in the police report and will give an officer more reason to remember your case.
If you are pulled over in a vehicle, provide the officer with your license and registration. When the officer is asking questions, only give your name and address. Do not perform any field sobriety tests. Keep in mind that once an officer's attention is on your vehicle, they are making observations of everything you do in order to determine if you are impaired. This includes how you are driving, what you do after being signaled to stop, and when the officer approaches the vehicle. For example, they will observe if they can smell alcohol, if any alcohol containers are in the car, if you fumble for your license when asked to retrieve it, and if your speech is impaired, just to name a few.
Keep your license and registration somewhere that is easy to access if you are pulled over. If it appears to the officer that you have trouble retrieving it, he may believe you are impaired.
If you are at home, do not let them in unless they have a warrant. Do not answer any questions, other than your name, until you have an opportunity to speak with a criminal attorney.
Things Not to Do
If you are at home, do not let officers in unless they show you a warrant. Do not answer any questions, other than to provide your name, until you have an opportunity to speak with a criminal attorney. In every instance, do not be rude. If pulled over in your vehicle, do not perform any Field Sobriety Tests (FST). FST's are designed to provide evidence that you may be impaired.
